Due Diligence on QuestNet Ltd legality in Malaysia

QUESTNET Ltd is a multinational company recognised and accepted internationally as a reputable retailer of gold and luxury products with a head office in Hong Kong.

1) Please go to this website https://211.24.166.66/uni/findroc.php, 993949-P (type this no.) you will find that QuestNet Ltd is registered company in Malaysia. Other companies namely may not be related to Qi Ltd. Wawasan QI Holdings Sdn Bhd (720115-K) and Wawasan QI Properties Sdn Bhd (733462W).

3) In a nut shell, Questnet is Customer Service Centre where doesn't require to have DSA license whereas QN Global distribute health care products with MLM plan and local distributors require DSA license.

4) As regards Direct Sales Act 1993, whichever licenses that require Questnet to carry, they have already done their part. It could be our LAW is not up-to-date to include e-Commerce. If one is talking about Direct Purchase by e-Commerce, this does not cover under DSA. People can buy computer parts via Dell.Com, People can buy books via Amazon.com, people can buy Coins via Quest.Net, People can buy anything from any part of world as long as legal to import into Malaysia. And these are NOT COVER under DSA. People who are carrying bags selling toothbrushes door to door, YES - direct sales. Mail Order, yes Direct Sales. In Singapore, it's MLM License. Questnet will consult local authorities for licensing. They are better in protecting themselves first before running the business. Of course, smart businessmen will do it legally. That's why they are SO RICH TODAY!! And people are still talking about it TODAY that they are not a registered under DSA (may need an e-Commerce Act).

 

 
5) Looking at QN Global co. ref no. 656866-W, in QN Global they don't give any hints that they're related to Questnet or GoldQuest but they may have the same Managing Director. And the Direct Sales License is issued for QN Global which is selling Wellness supplements. Can they use that Wellness Supplements DSA license for other company? QUESTNET LTD co. ref no. 993949-P.  Is that legal? Anyway I would get clarification from Domestic trade.
 

Comments: I have emailed to Domestice Trade today and pending reply (Will update it later). Anyway, these 2 companies are registered as "QN Global co. ref no. 656866-W" and another as "QUESTNET LTD co. ref no. 993949-P".

One of them "QN Global co. ref no. 656866-W" is given a Direct sales license for doing business trading with wellness products. I guess it isn't difficult to get a license approved for that since there is so many companies that is selling wellness product under NM. While another company "QUESTNET LTD co. ref no. 993949-P" is not given a direct sales license but is selling numismatic products through e-Commerce. When there are no local distributors, is it necessary to apply for Direct Selling licence?

6. Did Questnet register their MLM business in Malaysia?

Yes and No!
A) QN Global co. ref no. 656866-W is issued DSA license because they (the registered company deals with wellness/food supplements and engage local distributors.
B) QUESTNET LTD co. ref no. 993949-P is NOT issued any DSA license and they deal with the coins and jewellery via e-Commerce.

C) Questnet is a company registered in Malaysia and so is a legal entity to conduct e-Commerce locally.

Re: Legality of QUESTNET LTD to conduct e-Commerce business in Malaysia

QUESTNET LTD co. ref no. 993949-P is exempted from a direct sales licence because it is a Customer Service Centre or e-Commerce centre and not a Direct selling Company.

Is QUESTNET Ltd truly exempted from Direct Selling licensing? At present, there are many Independent Representatives for QUESTNET, not known as distributors, in Malaysia.

Is there any breach of relevant laws in Malaysia for QUESTNET to conduct e-Commerce in Malaysia?

Kindly help to clarify my doubts on the above legal issue.
